The Parties
This agreement is between “The Filmmakers Channel” the “Provider” and the filmmaker also known as the “Client.”
The Scope
This document defines the terms, conditions and obligations of the provider and client as it pertains to the
marketing and distribution of client films and media. Client may select from one of two service levels. The can either do all of the setup work themselves, or they can have the Filmmakers Channel do the setup for them for an additional fee.
Special Note Regarding Pay Per View: The Filmmakers Channel uses a 3rd Party Streaming Video provider called Maxcast for Pay Per View and storage services. The Filmmaker will enter into a separate agreement with Maxcast to secure these. Maxcast offers four subscription levels payable directly to Maxcast starting at $9.95/month.
General Agreement – Filmmaker Setup
Starting in 30 days from the conclusion of this transaction, the client will pay the provider, The Filmmakers Channel $9.95 each month and in exchange clients can
- Post an unlimited number of films on The Filmmakers Channel for no additional fee.
- Set any price of their choosing for their Pay Per View film, video, or DVD
- Sell as many copies of their film or video on DVD, or Pay Per view.
- Get a listing on “Adopt-A-Film.Com website for each film posted on The Filmmakers Channel
- Get a WordPress website with 100 MB of space, unlimited bandwidth with The Filmmakers Channel with proprietary Adopt a Film software installed.
- Get discounted pricing on a custom designed Word Press site using the Filmmakers Channel proprietary Film Theme.
- Get a step by step checklist with how to videos for getting their film, video or DVD available for purchase.
- Get access to a training video library covering basic and advanced Word Press usage as well as internet marketing.
- Get a press release written and submitted by The Filmmakers Channel once their film is made available.
General Agreement – Filmmakers Channel Setup for Filmmaker
For an additional one time fee of $20.00 per film or video The Filmmaker Channel will provide items as listed above. This relieve the client of the technology necessary to setup their film by doing everything necessary to get the clients film on The Filmmakers Channel and Adopt a Film. This includes the following….
- Create a contiguous video file of the clients movie suitable for Pay-Per-View streaming on Maxcast that is web optimized MP4.
- Create a Maxcast Pay-Per-View account and purchase an appropriate Maxcast subscription on behalf of the client in the client’s name as an account they own.
- Upload the clients’ movie to the clients Maxcast account and properly configure it for Pay-Per-View streaming at a price to be set by the client.
- Provide access to all Maxcast training allowing them to leverage Pay-Per-View capabilities from their site or others who may adopt their film.
- Upload clients DVD to Kunaki for automated fulfillment services in the clients’ name at a per copy price defined by the client.
- Provide client with all URLs or links to the Pay-Per-View or DVD for the clients use in other venues attheir discretion.
- Add the clients film to The Filmmakers Channel and “Adopt A Film” websites.
- Make clients film adoptable by other internet business owners at not expense to the client using “The Filmmakers Channel” proprietary :”Adopt A Film” software.
- Provide client user account access to The Filmmakers Channel” so they can manage their film listing at their own discretion
- Provide client login credentials on the “FilmmakersNation.Com” and make all training and support available.
- Configure all services so that proceeds from the sale of clients DVD or Pay-Per-View is paid directly to the client.
In support of this the client will provide “The Filmmakers Channel” with
- A DVD of their film for us to use a source material for PPV and DVD distribution.
- DVD artwork (faceplate and DVD cover) – If artwork is not available we can create it by scanning the images from the DVD for a $5.00 surcharge.
- Trailer of their film
- Pay Pal email address for direct payment to the filmmaker.
- Provide email address for “Adopt a Film” purposes
General Agreements
- Client agrees not to change any settings such as username or password on Maxcast or Kunaki, hence disabling access by The Filmmakers Channel without also notifying The Filmmakers Channel
- To keep Maxcast account in good standing so as to ensure uninterrupted Pay-Per-View availability on “The Filmmakers Channel” or associated networked websites.
- To reply to any comments of their film left by viewers on “The Filmmakers Channel” promptly.
- Client agrees to allow “The Filmmakers Channel” to upload a trailer of the clients movie to various distribution websites for marketing purposes.
- Client understands that “The Filmmakers Channel” will apply best efforts but makes no warranties, or guarantees regarding the commercial success of the clients film.
- The Filmmakers Channel makes no claims in whole, or part to the filmmakers film.
- Filmmaker, client understands that Pay Per View streaming is done through a 3rd party and that The Filmmakers Channel has no part in any such agreement and is completely between the client and Maxcast.
- The Filmmakers Channel makes no claim in whole or part to commissions from any sales.
- This is a non binding agreement and can be cancelled at any time for any reason by any part.
